政治与宗教的关系问题长期为我国法学界所忽视。三亚市政府对三亚观音圣像建设的直接参与、扶持和收购行为是利用我国“政教分离”这块法律处女地的权力滥用行为。它不仅违背我国宪法原则,而且也是我国政教分离原则缺乏法律保障的现实表现。因此,研究和探讨宗教信仰自由与政教分离的关系以及相关法制问题具有重要的现实意义。
The issue of the relationship between politics and religion has long been neglected by the jurisprudence of our country. The direct participation, support and acquisition by Sanya municipal government in the construction of the Sanskrit icon of Sanya are the abuse of the power of virgin land in China’s “separation of church and state” law. It not only runs counter to the constitutional principle of our country, but it is also a realistic manifestation of the lack of legal guarantee for the separation of church and state. Therefore, it is of great practical significance to study and discuss the relationship between the freedom of religious belief and the separation of the state and the church, as well as the related legal issues.
