诱惑侦查的合法性的认定标准有主观标准、客观标准和混合标准三种,但它们各有其缺陷。应当对混合标准进行改造,混合标准中的客观、主观成分之间的关系应为或然关系,应当为不同的违法情况规定不同的法律后果。《刑事诉讼法》第152条第1款中的“必要的时候”和“不得诱使他人犯罪”有待澄清。 There are three subjective criteria, objective criteria and mixed standards to determine the legitimacy of temptation investigation, but each has its own defects. The mixed standards should be reformed. The objective and subjective components in the mixed standards should be related by a natural relationship, and different legal consequences should be stipulated for different illegal situations. Paragraph 1 of Article 152 of the Code of Criminal Procedure shall not be invoked to induce others to commit crimes “when necessary” and “to be clarified.”
