《国有土地上房屋征收与补偿条例》删除了非公共利益拆迁。于是,商业拆迁如果继续实施,必须得到双方全体一致的同意,本文谓之自然权利观的体现。但是,自然权利直接转化成法律条款有着其固有的条件,目前的任何一种拆迁都涉及到三方关系,具有特定的历史特点,不适用抽象的自然权利规则。拆迁问题是利益问题,不纯其为权利问题,交予权利解决,不仅没有看到问题的实质,而且会出现乱局,简单的问题复杂化。应该参照社会法学派的观点对现有的拆迁关系的主体之间进行利益衡量。政府必须直接面对被拆迁人,以具体的规定代替无边无际的协商。以最小的牺牲换来最大的利益,实现多赢的效果。
The State-owned Land Expropriation and Compensation Ordinance deleted the demolition of non-public interests. Therefore, if the commercial relocation continues to be implemented, it must be unanimously agreed by both parties, which is the embodiment of the article’s concept of natural rights. However, the direct conversion of natural rights into legal provisions has its own inherent conditions. At present, any kind of demolition involves the tripartite relations with specific historical features and does not apply abstract natural rights rules. The issue of demolition is a matter of interest. Impure as it is a question of rights and a settlement of rights, not only fail to see the essence of the problem, but also create chaos and simple problems. We should refer to the perspective of social law school to measure the interests of the existing relationship between the main demolition. The government must face the demolished people directly and replace the immaterial negotiation with concrete provisions. In the least sacrifice in exchange for maximum benefit, to achieve win-win results.
