我建议对1986年12月2日公布、1988年11月1日起生效的《中华人民共和国企业破产法(试行)》进行适当修改,尽快颁布一部不带“试行”字样的企业破产法.必要性、可行性、紧迫性修改企业破产法的理由可以概括为:随着历史的发展,人们对企业破产法的认识有了提高,已有可能对于企业破产法试行实践中提出的问题在立法上作出相应的改变.众所周知,摆在我们面前的现行企业破产法,是中国大陆几十年立法史上空前激烈辩论的产物,它充分反映了当时立法机关所能达到的认识水平.换句话说,当时全国人大常委会未能采用、而实践证明是应当采用的某些提法,也就是那时在认识上的历史局限性.
I propose that the Enterprise Bankruptcy Law of the People’s Republic of China (Provisional) promulgated on December 2, 1986 and effective on November 1, 1988 be amended as appropriate and an enterprise bankruptcy law should be promulgated as soon as possible without the words “pilot”. Necessity, Feasibility and Urgency The reasons for amending the Bankruptcy Law can be summed up as follows: With the development of history, people’s awareness of the Bankruptcy Law has been raised, and it is possible that the legislation put forward in the practice of bankruptcy law As we all know, the existing corporate bankruptcy law before us is a product of unprecedented and vigorous debate in the legislative history of several decades in Mainland China, and it fully reflects the level of awareness that the legislature could reach at that time.In other words, At that time, the NPC Standing Committee failed to adopt it, and the practice proved to be some of the references that should be adopted, that is, the historical limitations of understanding at that time.
