新闻报道中侵害名誉权现象在司法实践中较为普遍。新闻名誉侵权是报纸、电视、广播等新闻机构或者个人在新闻报道、新闻批评以及新闻评论中侵害公民或法人等民事主体名誉权的行为。对新闻名誉侵权的责任主体、“内部刊物”新闻名誉侵权、报道内容严重失实、新闻名誉侵权行为的不作为形式、新闻名誉侵权的抗辩事由等方面进行认定和分析。
