新闻自由在现代宪政制度中的重要地位和作用已经得到了普遍的认可,不论在东方还是西方,在不同的体制中都有着非一般的意义。美国的新闻自由制度的主要法律保障来源主要是宪法《第一修正案》,“五角大楼文件案”是美国新闻自由制度的经典案例,更是说明了新闻自由的重要程度。而中国的新闻自由保护虽然也写入宪法,但在现实生活中却没有法律的支撑,没有详细的规定,很难起到保护和监督作用,本文从两个方面入手对我国的新闻自由制度提出几点拙见。
The important position and role of the freedom of the press in the modern constitutional system have been universally acknowledged. Both in the East and in the West, the freedom of the press has a non-ordinary meaning in different systems. The main source of legal protection in the press freedom system in the United States is mainly the “First Amendment” of the Constitution. The “Pentagon Papers” is a classic case of the freedom of the press in the United States. It also shows the importance of freedom of the press. Although the freedom of the press in China is also written into the constitution, it has no legal support in real life. Without detailed rules, it is very difficult to protect and supervise the freedom of the press. Starting from two aspects, A few humble opinion.
