近年来,中国家庭养老功能在不断弱化,而人口老龄化问题越来越严重,老年人的合法权益受损问题也日趋严重。在此种情况下,完善老年人监护制度就显得尤为重要。应对家庭养老功能的弱化,我们需要从法制层面上变革与完善当今的老年人监护制度,实现真正的“老有所依”。
In recent years, the functions of providing end-of-life for Chinese families have been constantly weakened, and the problem of population aging has become more and more serious. The problems of the impairment of the legitimate rights and interests of the elderly have also become increasingly serious. Under such circumstances, it is particularly important to improve the system of guardianship for the elderly. In response to the weakening of the family endowment function, we need to change and perfect the current guardianship system for the elderly from the perspective of the legal system so as to achieve a true “old age”.
