国家之间法律制度相互协助就是司法协助的实质。随着经济全球化的不断深入,国际民商事争议纠纷越来越多,各国法院亟需通过国际民事司法协助制度来处理争议案件。尤其在当前中俄经贸合作加大加深对司法协助工作的需求加大加快,而中俄现有民事司法协助正在面临立法和实践的双重挑战,因此亟需大力完善民事司法协助机制。
Mutual legal assistance between countries is the essence of mutual legal assistance. With the continuous deepening of economic globalization, there are more and more disputes over international civil and commercial disputes and the courts of various countries urgently need to handle controversial cases through the system of international civil justice assistance. In particular, the current economic and trade cooperation between China and Russia deepens the need for deepening judicial assistance work more rapidly. However, the existing civil judicial assistance between China and Russia is facing the dual challenges of legislation and practice. Therefore, it is imperative to vigorously improve the mechanism of civil judicial assistance.
