北京政府建立后,为了加强对司法官的管理,制定并颁布了一系列有关司法官惩戒的法规、条例、命令,并在实践中加以贯彻执行,初步构建了中国近代司法官惩戒制度。该制度在监督和规范司法官的行为、保障司法官队伍的廉洁公正方面起到一定的作用,对当今法官制度建设也不无借鉴意义。但是,由于制度本身存在一些缺憾与不足,加之规定与实际操作方面存在一定程度的背离,北京政府司法官惩戒制度远没有达到应有的效果。
After the establishment of the Beijing government, in order to strengthen the administration of the magistrate, a series of laws, regulations and ordinances concerning the disciplinary punishment of the magistrate were formulated and promulgated. The implementation of the system was implemented in practice, and the system of disciplinary punishment by modern Chinese magistrates was initially established. The system plays a certain role in supervising and standardizing the behavior of judicial officials and ensuring the integrity of judicial officers. Nor does it provide any reference to the construction of today’s judicial system. However, there are some shortcomings and shortcomings in the system itself, and there is a certain degree of deviation between the regulations and the actual operations. Therefore, the system of disciplinary punishment by the Beijing government judges is far from achieving the desired results.
