试点改革已经成为我国经济改革、政治改革及司法改革、社会改革、文化改革普遍采取的基本路径,甚至是国家制定法律的重要路径。以经济领域为例,我国采用试点改革的有经济特区、综合配套改革试验区、自贸试验区等。改革试点区的很多政策优惠都在减弱或者消失,最大的优惠或者权利就是先行先试的权力。先行先试就必然要突破现有制度的局限实现制度创新,在某种程度上就是法律改革。因此,先行先试与改革于法有据两者之间难以避免存在一定张力甚至冲突。从我国目前改革试点地区的做法来看,先行先试主要体现
