诉讼期间(Litispendence;Die Rechtshangigkeit),又称诉讼中止或诉讼未决。这是国际民事诉讼中当原告呈交书面的诉讼请求,法院着手进行诉讼程序时,案件在该法院处于未决状态的情形。从国际民事诉讼角度分析,诉讼期间主要涉及的问题是:(1)内国是否应承认外国的讼诉期间?承认后是否可阻止在内国进行的相同当事人间相同诉讼关系的诉讼?(2)诉讼期间开始后确定管辖权的条件变化在多大程度上影响内国法院的管辖权?(3)应由哪一个诉讼法规定共同诉讼,互相诉讼,两诉竞合的条件?下文中,笔者试图在各国学者研究的基础上,对诉讼期间问题作一点探讨和介绍。
During the proceedings (Litispendence; Die Rechtshangigkeit), also known as litigation suspension or litigation pending. This is the case in international civil lawsuit where the plaintiff submits a written claim and the court commences the proceedings when the case is pending in the court. From the perspective of international civil litigation, the main issues involved in the litigation period are: (1) Should the Mainland recognize the period of foreign litigation? Will it prevent the litigation in the same litigant with the same litigations held in the Mainland after admission? (2) Litigation After the start of the period to determine the conditions of change of jurisdiction to the extent of the jurisdiction of the domestic courts? (3) Which of the litigation law should be provided for litigation, mutual litigation, the conditions for two competing? In the following, On the basis of the scholars’ research, this article makes a brief discussion and introduction on the issues during the litigation period.
