美国在过去的40年间,逐渐发展成一套相当完整周延的保障两性工作平等的法律体系。内容涵括一般就业上性别歧视之禁止、两性薪资报酬之平等、两性职场隔离之突破、工作场所性骚扰之禁止、怀孕歧视之禁止、母性保护及家长休假制度之设计以及积极的行政奖励方案之推动等事项。本文拟作一整体的说明,并评估其优劣得失,为我国建构相同的制度时参考。
Over the past 40 years, the United States has gradually developed into a rather complete legal system that guarantees equal work for both sexes. These include the prohibition of gender discrimination in general employment, the equal pay of both sexes, the breakthrough of gender segregation in work, the prohibition of sexual harassment in the workplace, the prohibition of pregnancy discrimination, the design of the maternity protection and parental leave system, and the promotion of a positive administrative incentive scheme Other matters.
