现行仲裁制度产生于经济体制改革初期,不可避免地打上了许多计划经济体制的烙印,因此改革现行仲裁制度已成为完善社会主义法制建设的一项重要课题。八届全国人大常委会第三次会议《关于修改(中华人民共和国经济合同法)的决定》(下称《修改决定》)为我们改革现行仲裁制度提出了法律要求。笔者现就我国仲裁制度改革谈些思路。 一、仲裁的本质 仲裁,也称公断,即公正地裁断,是指当事人双方发生纠纷后,协商解决不了,或者双方不愿协商,而请求第三者依照双方约定或法定的程序对争议的事项居中进行公正裁断的一种行为。
