要保持人民法院在当前加强民主法制建设进程中的正确方向和健康状态,进一步加强人大监督力度,尤为重要。作为人民法院如何强化接受人大监督意识,以更好地接受人大监督,是摆在我们面前的重要课题。笔者拟就这个问题谈点粗浅认识。一、要深刻认识人大监督在诸项社会监督中的性质、地位和作用。人大的监督在各种社会监督中占有特殊重要的地位与作用。首先,人大监督最具权威性。全国人民代表大会和地方各级人民代表大会作为国家的权力机关,在国家体制中具有绝对的权威地位,宪法赋予它对本级其他国家机关进行监督的权力是无限的。因此,尽管人民法院要普遍接受来自社会的广泛监督及有关机关的专门监督,但最重要、最根本的还是接受人大监督。全国人大及其常委会的监督是最高层次的监督;地方人大及其常委会的监督在当地也是同样。当然,这里绝不是说其他的社会监督无关紧要。其次,人大监督具有全局性。一是人大对法院的监督较之其他监督,更易于从法制建设的整体出发,从全局上考虑、发现和解决问题。二是由于人大代表人民、 It is especially important to keep the people’s court in the correct direction and state of health in the current process of building a democratic legal system and to further strengthen the oversight of the people’s congress. The supervision of the NPC and its standing committee is the highest level of supervision; the supervision of the local people’s congress and its standing committee is the same locally. Of course, this is not to say that other social supervision does not matter here. Second, the oversight of the NPC has the overall effect. First, the people’s congress’s supervision over the courts is easier than ever to supervise from the overall perspective of the construction of the legal system, so as to consider and find out and solve the problems on the overall situation.
