纵观现今法学的学术研究,大多是围绕着对某一法律制度或是某一单个法条所进行的。虽然这样的研究能够为法律的完善提供很大的帮助,但法律最终是需要实践的,而不是单纯的通过理论上的构想就能够完全适应社会需求。因此,需要我们转换视角,将研究方向由立法中心主义向司法中心主义转变,这个过程也体现了实践理性在司法中的价值。
Looking at the current academic research, mostly around a legal system or a single law. Although such research can greatly help the improvement of law, the law ultimately needs to be practiced rather than being able to fully meet the needs of the society simply by theoretical assumptions. Therefore, we need to change our perspective and change the direction of our research from legislative centralism to jurisprudence. This process also reflects the value of practical rationality in the judiciary.
