劳动正义是社会的底线公平,不公平的劳动解雇是引发社会正义问题的重要根源。但是,西方长期以来从自由主义原则出发,将对劳动解雇中的不公平问题探讨限定在私人交易市场问题的解释框架之内。从某种意义上来说,柯林斯重构了这一理论解释框架,他认为个人权利和自主权尊重应该成为衡量劳动解雇是否公平的基本原则,推动程序正义与实体正义的双重实现。柯林斯劳动解雇中的正义理论具有重要的价值,不仅有助于丰富马克思劳动正义理论,批判与解读劳动解雇的非正义性,同时也为建构中国特色社会主义的劳动正义理论提供重要的启示。
Labor justice is the bottom line of society fair and unfair dismissal is the root cause of social justice. However, the West has long embraced the principle of liberalism and will discuss the issue of inequity in employment dismissal within the framework of interpretation of the private trading market. In a sense, Collins reconstructed the theoretical framework of interpretation. He believed that the respect of individual rights and autonomy should become the basic principle to measure the fairness of the dismissal and promote the double realization of procedural justice and substantive justice. Collins’s theory of justice in labor dismissal is of great value. It not only helps enrich Marx’s theory of labor justice, criticizes and interprets the injustice of labor dismissal, but also provides important inspiration for constructing the theory of labor justice with Chinese characteristics.
