目前中国许多城市受到垃圾问题的困扰,垃圾分类是目前发达国家普遍采用的源头减量垃圾的方法,然而中国垃圾分类起步晚,法律不够健全,实践中存在较多问题。本文通过对法律现状的剖析,明确垃圾分类制度的必要性和可行性,提出通过完善现有法律、制定专项法律的手段来规制垃圾问题,使垃圾分类不流于形式,实现真正垃圾分类回收,促进资源循环利用。
At present, many cities in China are plagued by garbage problems. At present, garbage classification is a widely used source of reducing garbage in developed countries. However, the classification of waste in China started late, the law is not perfect, and there are many problems in practice. Through the analysis of the status quo of the law, this paper clarifies the necessity and feasibility of the waste separation system. It proposes to regulate the waste problem by perfecting existing laws and enacting special laws so that the waste separation does not fall into the formality and real waste separation and recovery are realized. Promote recycling of resources.
