近几年司法考试通过率有加速度提高之趋势,其在选拔不少法律人才的同时,也带来了一些负面影响,特别是降低了人才的素质。这其中既有认识方面的误区,也有制度设计方面的原因。在当前的背景下,应把司法考试的通过率控制在较低的范围内,保证人才的高质量,以体现司考的选拔性功能;同时,借鉴国外经验,逐步提高报考人员的资格条件,在此基础上,再逐步提高司考通过率,以实现法律人才的社会需求与法律人才精英化培养的有机结合。
In recent years, the pass rate of judicial examination has been accelerating. This trend has also brought some negative effects on the selection of quite a few legal professionals, especially the quality of qualified personnel. Among them, there are misunderstandings in cognition and also the reason of system design. In the current context, the pass rate of judicial examination should be controlled within a relatively low range to ensure the high quality of talents in order to reflect the selective function of the exams. At the same time, drawing on the experience of other countries and gradually improving the qualifications of applicants, On this basis, the gradual improvement of the passing rate of the examination should be carried out in order to realize the organic combination of the social needs of law professionals and the cultivation of legal talents.
