我国劳动就业制度改革经历30年,劳动合同制从最初在个别重点城市的试点企业试验到在全国范围铺开,目前已经成为我国劳动力就业的主要制度,30年中,劳动合约发生了深刻的变化,劳动合约的形式日益多样化,劳动契约关系越来越复杂,本文概括了转型时期我国劳动契约演变的特点,并从市场化、产权变迁、法治化及国际化多角度分析我国劳动契约演变的原因与动力,以及我国《劳动合同法》出台的必然性及实施中可能面临的问题。

This article summarizes the characteristics of labor contract evolution during the transitional period in China and analyzes the evolution of labor contract in China from the perspective of marketization, property rights change, legalization and internationalization Causes and motivation, as well as the inevitability of the promulgation of “Labor Contract Law” in our country and possible problems in its implementation.
