一、在我国刑法中规定国际犯罪的必要性目前我国参加的与国际犯罪有关的多边条约有十多个,这些国际条约一般都规定,缔约国对犯有国际罪行的罪犯,有权行使管辖权。1987年6月23日,全国人大常委会根据履行国际义务的需要,作出了相应规定:“对于中华人民共和国缔结或参加的国际条约所规定的罪行,中华人民共和国在所承担条约义务的范围内,行使管辖权。”而国际条约赋与缔约国对国际犯罪的普遍管辖权又包括承担“或起诉或引渡”这两方面的义务。因此,必然要求在我国刑法中对国际犯罪的普遍管辖权和引渡制度作出规定。刑法中有了对国际犯罪的普遍管辖权和引渡制度的规定,是否就完善了呢?显然仍是有很大缺
I. The Necessity of Stipulating International Crimes in Our Criminal Law There are currently over a dozen multilateral treaties to which our country is a party. These international treaties generally stipulate that the State party has the right to exercise jurisdiction over criminals guilty of international crimes. On June 23, 1987, the NPC Standing Committee made the corresponding provision according to the needs of fulfilling its international obligations: “For the crimes stipulated in the international treaties concluded or joined by the People’s Republic of China, the People’s Republic of China, within the scope of its treaty obligations , Exercising jurisdiction. ”However, the international treaty confers universal jurisdiction over international crimes in the State party and includes the obligation to“ prosecute or extradite ”it. Therefore, it is necessary to stipulate the universal jurisdiction and extradition system of international crimes in our country’s criminal law. Is it perfect if there is a provision in criminal law that has universal jurisdiction over international crimes and a system of extradition?
