行政复议是现代国家解决行政争议的法律制度之一。我国种子管理的实体法规《中华人民共和国种子管理条例》(以下简称条例)第四十三条及《中华人民共和国种子管理条例农作物种子实施细则》(以下简称细则)第八十二条规定:当种子管理机关与管理相对人发生争议时,都要以复议作为解决争议的前提条件。因此复议是市(地)级以上种子管理机构的一项法规授权的重要工作,也是我们种子系统内部层级监督管理的具体表现和上下级关系的一种确认。但从目前的情况看,种子管理案件的复议还刚刚起步,全国至今还没有一个完整、统一、实用的程序,遇到行政复议案件时,往往手忙脚乱,无所适从。本文依据《行政复议条例》的《条例》,结合笔者在办案中的实践,参照其他行政执法部门成功的经验,对种子管理的行政复议工作加以探讨,以期抛砖引玉,搞好种子管理的行政复议工作。
Administrative reconsideration is one of the legal systems in modern countries for settling administrative disputes. Article 43 of the Regulations on Seed Management in the People’s Republic of China, Article 43 of Regulations of the People’s Republic of China on Seed Management (hereinafter referred to as the Regulations) and Article 82 of the Regulations on the Implementation of the Crop Seed Regulations of the Regulations on the Control of Seed of the People’s Republic of China (hereinafter referred to as the Rules) When a dispute arises between the seed management authority and the management counterpart, a reconsideration shall be taken as a precondition for resolving the dispute. Therefore, the reconsideration is an important task authorized by the laws and regulations of the seed management institutions above the city (prefecture) level, and is also a confirmation of the specific performance and the relationship between the superior and subordinate levels of the supervision and management within our seed system. However, judging from the current situation, the reconsideration of the case of seed management has just started. There is still no complete, uniform and practical procedure in the country so far. When faced with administrative reconsideration cases, they are often confused and confused. Based on the “Regulations” of the “Regulations on Administrative Reconsideration” and the author’s practice in handling cases, and referring to the successful experiences of other administrative law enforcement departments, this article discusses the administrative reconsideration work of seed management in order to promote the administrative reconsideration of seed management .
