“临阵先退者处死”作为军律,在大蒙古国时期即已存在,并通常体现为更加严酷的“同命队法”。本文从军律与政治军事形势互动的角度,考察了“临阵先退者处死”罚条的产生与发展演变。《至元条格》中“二十五年断例”将这一规定的适用范围扩大到管民官系统;《大德六年诏令》则对该断例进行了一定程度补充和完善。这一断例很可能被收入了自《大元通制》到《至正条格》等一系列元朝编纂的政书和法典中。
“The execution of first-come-first-come-first-served” as a military discipline existed in the Great Mongolian period and is usually reflected in the more rigorous “same-life team method.” This paper examines the emergence and development of the penalty of “death of Pro-first-come-descendants” from the perspective of military law and political-military situation. “Yuan Yuan” in the “twenty-five years of cases,” the scope of this provision will be extended to the management system; “Dad six years edict” is the case to a certain extent, supplemented and perfect. This example is likely to be reckoned with in a series of Yuan dynasties’ political documents and codes compiled from the “Dayantong system” to the “positive one.”
