建立反垄断咨询制度,有利于为经营者提供更为明确的法律预期,同时节约执法成本,促进提高反垄断执法能力,但同时也面临着一些约束条件。本文在借鉴美国和欧盟相关制度的基础上,提出了首先在反价格垄断领域建立任意性的咨询制度、严格设定咨询前提条件、明确咨询意见为行政指导性质和加强咨询意见信息公开等政策建议。 The establishment of antitrust advisory system is conducive to provide managers with more specific legal expectations, while saving the cost of law enforcement, and promote the ability to enhance anti-monopoly law enforcement, but also faces some constraints. On the basis of drawing lessons from the relevant systems of the United States and the EU, this paper proposes that we should first establish an arbitrary advisory system in the field of anti-monopoly prices, set strict preconditions for consultation, clarify policy advice on the nature of administrative guidance and enhance the disclosure of information on advisory opinions .
