一切条约都兼具造法性与契约性,所谓造法性条约和契约性条约都是国际法原则、规则和制度的表现形式,都具有创设国际法的法律效力。造法性条约由于能够创设一般国际法,因而具有更浓郁的造法性色彩;但这并不能否认在特定国家之间创设特殊国际法的契约性条约的国际法渊源地位。无论造法性条约还是契约性条约,都具有创设国际权利义务的功能,都是国际法的渊源。
All treaties have both legitimacy and contractuality. Both so-called constructive treaties and contractual treaties are expressions of the principles, rules and systems of international law, all of which have the force of law for creating international law. Formative treaties have a richer man-made paean to the creation of general international law; however, this does not deny the origin of the international law of treaty-based treaties that create special international law between particular countries. Both the making of conventions and the contractual treaties have the function of creating international rights and obligations and are all sources of international law.
