【裁判要旨】不动产买卖中,当事人未办理登记手续只是不发生所有权转移,并不影响买卖合同本身的效力;买卖合同的效力判断应依据合同法进行。合同法第五十二条第(五)项中的强制性规定应当区分为效力性规定与管理性规定,只有违反效力性强制规定才必然导致合同无效,不动产买卖中,未办理登记手续所违反的是管理性强制规定,从而不能导致合同无效。
