随着社会的进步,人们生活水平的提高,花样繁多的食品也不断涌入人们的生活,然而,现代社会的发展使食品安全问题越来越突出。“三聚氰胺毒奶粉”、“瘦肉精事件”、“地沟油”、等一件件食品安全事故像永远都有续集的电视连续剧一样,考验着消费者的神经。从已经被曝光的食品安全事件不难发现,监管部门普遍存在被动监管现象。并且,每次食品安全问题发生后,监管部门“理直气壮”地把矛头指向肇事者,但监管部门和监管人员的失职却易被忽视。从法律的角度来观察,它反映出我国有关食品安全监管中政府责任法律制度的部分缺失与低效。本文拟主要从法学方向出发结合其他相关学科,对食品安全监管的法律问题进行有益的理论探讨。
With the progress of the society, the improvement of people’s living standard and the huge variety of food are pouring into people’s daily life. However, the development of modern society makes the issue of food safety more and more prominent. “Melamine tainted milk ”, “clenbuterol incident ”, “waste oil ”, and a piece of food safety incidents like the TV series will always have the sequel, the test of the nerves of consumers. From the food safety incidents have been exposed is not difficult to find that there is widespread passive supervision of regulatory agencies. And, every time a food safety problem occurs, regulators “confidently” target the perpetrators, but the negligence of regulators and supervisors is easily overlooked. From a legal point of view, it reflects the lack of efficiency and inefficiency in our country’s legal system of government responsibility in food safety regulation. This article intends to start from the law mainly combined with other related disciplines, the legal issues of food safety regulation useful theoretical discussion.
