(XIII) Canadian Bill of Rights - People may well wonder why there is a very similar situation in Canada. The 1867 Britannica Act, which is applicable to the Canadian Constitution, does not contain a Declaration of Rights, but this gap was filled by the passing of a Bill of Rights by the [Canada] Federal Parliament in 1960. The issue of the power of this Bill of Rights has been the subject of much controversy, but the Supreme Court of Canada ruled in 1970 that statutory law could not be enforced if it contrasted with these principles, which are contained in the Bill of Rights.
