我国立法关于抵押物转让制度的规定由《担保法》第49条过渡到《担保法解释》第67条最终于《物权法》第191条中确定,其内容过于注重保护抵押权人的利益,偏失交易安全的考虑。同时造成了与《物权法》总则、第188条的登记对抗主义、动产占有公信力等规则的冲突。本文认为,未来抵押物转让模式应当赋予抵押权追及效力,同时配之以代价清偿、代为清偿两项规则用以涤除抵押权。
