我国市场经济的平稳运行依靠经济规律的有效调节,竞争机制在这个过程中发挥着不可或缺的杠杆作用;而不正当竞争的出现无疑会窒息市场活力,危害贸易环境,干扰社会经济的健康发展。市场经济秩序,应从法律上和政策上对这类不正当竞争加以有效制止。本文拟从规制不正当竞争行为的原则以及不正当竞争行为的法律界定和表现等几方面进行探讨,希望给经济决策者和立法者以启示和借鉴。
The smooth operation of the market economy in our country depends on the effective regulation of the economic laws. The competition mechanism plays an indispensable leverage in this process. The emergence of unfair competition will no doubt stifle the vitality of the market, jeopardize the trading environment and disrupt the healthy development of the society and economy . Market economic order should be effectively deregulated from such legal and policy issues as unfair competition. This article intends to explore the principles of regulating unfair competition and the legal definition and performance of unfair competition. It is hoped that this can help enlighten economic policy makers and legislators.
