现阶段理论界对于检察机关提起的行政公益诉讼是否适用调解仍然有很大的争议,反对调解的观点认为检察机关代表的是社会公共利益,其无权擅自处分权利。支持调解的观点认为在不损害社会公共利益的前提下,检察机关提起的行政公益诉讼可以适用调解。本文尝试从调解的目标价值、效率价值、平等价值、自由价值等方面来阐明在检察机关提起行政公益诉讼中适用调解的合理性,进而从调解适用范围、调解的启动及审级的适用、调解的效力等方面就检察机关提起行政公益诉讼中的调解制度的构建提出具体的建议。
At this stage, there is still a lot of controversy over the suitability of administrative public interest litigation initiated by the procuratorial organs. The argument against mediation holds that procuratorial organs represent the public interest in society and that they have no right to dispose of their rights without authorization. The view that supports conciliation thinks that without prejudice to the public interests of the public, prosecutors filed administrative mediation suit may apply mediation. This article attempts to clarify the rationality of mediation in the prosecution-initiated administrative public interest litigation from the aspects of target value, efficiency value, equality value and free value of conciliation, and then from the mediation scope, the initiation of mediation and the application of trial grade, Effectiveness and other aspects of the prosecution to bring the administrative mediation proceedings in mediation system put forward specific recommendations.
