办理制毒物品犯罪案件遇到的困难之一,就是相关立法司法的滞后性所带来的阻碍。本文从有关制毒物品的刑事立法、司法以及与之配套的行政立法存在的缺陷入手,阐述了修改理由,提出了有关制毒物品的立法和司法建议。
One of the difficulties encountered when handling drug-related crime cases is the hindrance caused by the lagging nature of the relevant legislative and judicial provisions. This article starts with the defects of the criminal legislation, the judicature and the related administrative legislation of the drug-making articles, elaborates the reasons for the amendment and puts forward the legislative and judicial suggestions on the manufacture of the drug.
