如何界定检察权的属性将直接关系到检察制度的整体设计及其应有的制度功能。明确检察行为的性质是界定检察权属性的前提。界定我国检察制度中检察权的属性,既要立足于我国宪政理论与实践,又要结合我国立法实际与司法现状。在我国,检察权不是一般的行政权,检察机关虽然是国家的法律监督机关,但检察权并不是简单的法律监督权。必须承认,我国的检察权具有司法权属性。在坚持这一认识的前提下,我们还必须理性看待检察权是兼有行政权与司法权双重属性的准司法权的认识和主张。
How to define the attributes of procuratorial power will directly relate to the overall design of procuratorial system and its proper institutional functions. The nature of the procuratorial act is a prerequisite for defining the procuratorial authority. The definition of procuratorial power in procuratorial system in our country should not only be based on the constitutional theory and practice of our country, but also combine with the reality of our country’s legislation and the status of the judiciary. In our country, procuratorial power is not a general administrative power. Although the procuratorial organ is the legal supervisory organ of the state, procuratorial power is not a simple supervisory power of law. It must be admitted that the prosecutorial power of our country has judicial power. On the premise of adhering to this understanding, we must also rationally view that procuratorial power is a quasi-judicial right that combines the dual attributes of executive power and judicial power.
