2014年3月,一起“幼儿园喂药”事件使社会视线再一次聚焦于虐待儿童入罪问题。因其伤害方式的新型性,现行刑法无法提供合适、准确的罪名对这一恶劣的行为追究刑事责任。面对近几年来日趋严重的虐童现象,现行法律法规已经无法有效地保护未成年人的合法权益,我国亟须对虐童行为进行刑法规制,这也是顺应世界发展潮流的需要。相比于单独设立虐待儿童罪,修正刑法中关于虐待罪的规定,扩大其主体和对象范围,并规定对虐待儿童行为从重处罚,更具有可行性。
In March 2014, the “Kindergarten Drugs” incident brought community attention once again to the issue of child abuse. Due to the new nature of the harm methods, the current criminal law can not provide appropriate and accurate charges to prosecute criminal acts of this abominable act. Faced with the increasingly serious abuse of children in recent years, the existing laws and regulations have failed to effectively protect the legitimate rights and interests of minors. It is imperative for our country to regulate criminal acts of child abuse, which is also in line with the needs of the world’s development trend. It is more feasible to amend the criminal law provisions on abuse of abusive drugs, expand the scope of subjects and subjects, and provide for heavier penalties for child abuse than to set up child abuse offenses alone.
