本文作者通过扎实细致的调查工作,归纳了城市房屋拆迁纠纷的特点,找出了在法律适用中存在的诸多问题,并提出了相应的建议和对策。作者认为,在我国的房屋拆迁实践中存在两种基本类型,一是不动产征收征用性质的公益拆迁,二是不动产流转性质的民间商业拆迁,然而现实生活中两种性质截然不同的拆迁却几乎全部由国务院《城市房屋拆迁管理条例》直接调整,造成了行政行为与民事行为混杂不分,行政法律关系与民事法律关系混乱不清的局面,也造成了司法实践中法律适用的迷茫和无奈。因此,严格区分这两种法律性质不同的拆迁,分别适用不同的法律,寻求不同的法定程序和救济途径,则因房屋拆迁引发的法律混乱可在一定程度上有所缓解。
Through solid and meticulous investigation, the author summarizes the characteristics of urban housing demolition disputes, finds out many problems existing in the application of law, and puts forward corresponding suggestions and countermeasures. The author believes that there are two basic types of housing demolition practice in our country. One is the demolition of public properties for acquisition and requisition of immovable property, and the other is the non-commercial commercial demolition of immovable property. However, almost two completely different types of demolition in real life The direct adjustment by the State Council of the “Regulations on the Administration of Urban Housing Demolition” has resulted in a mixture of administrative and civil actions, unclear confusion between administrative law and civil law, and confusion and helplessness in the application of law in judicial practice. Therefore, to strictly distinguish between the two demolitions of different legal nature, applying different laws respectively and seeking different legal procedures and relief channels, the legal disorder caused by demolition of housing can be alleviated to a certain extent.
