油轮船龄严重(相差10年以上)不符,是否构成光船租赁合同的“重大误解”,租船运输实务和航运界众说绘纭。一种观点认为,只要不影响船舶使用,船龄不符不构成光租合同的“重大误解”。另一种观点认为,船龄相差10年以上的油轮在航速、进出港、维修和防止油污等许多方面均有质的不同,且造成较大损失,构成“重大误解”。笔者赞成后一种观点,试用以下案例说明之。
