维护人民民主专政政权是警察权的重要内容,在构建社会主义和谐社会过程中,警察权的这一功能只能加强不能削弱。但随着我国社会结构和所有制形式的变化、社会自治领域的形成,社会价值观念趋于多元化,警察的社会管理职能及其公共权力的特征日益凸现。警察权作为公共权利的一种,本源于人民,并应服务于人民,在促进广大人民群众整体利益最大化的过程中同时实现社会成员个体利益的最大化;强制性以及必要时使用暴力是警察权得以顺利实现的有效途径,但不是目的,构建和谐社会的过程,也就是把强制性权威真正转变为合法性权威的过程;警察权还具有不断扩张的特性,必须对其进行规制。
To safeguard the people’s democratic dictatorship is an important part of police power. In building a socialist harmonious society, this function of police power can only be strengthened and weakened. However, with the change of the social structure and the ownership form in our country, the formation of the field of social autonomy and the diversification of social values, the police’s social management function and the characteristics of its public power have become increasingly prominent. As a kind of public power, the police power should serve the people and should serve the people. In the process of promoting the overall interests of the broad masses of the people, the police should simultaneously maximize the individual interests of the members of society. It is the police force that is mandatory and if necessary, However, it is not the purpose but the process of building a harmonious society, that is, the process of turning compulsory authority into the legitimating authority. The police power also has the characteristic of expanding continuously and must be regulated.
