以我国高等教育立法为基础,分析了高等学校法人地位的确立过程、高等学校法人的性质以及高等学校自主权的内容,在此基础上对高等教育立法的赋权模式和其他具体问题做出评价,提出建议。笔者认为,高等学校法人既包括其在民法上的民事主体资格,也包括其在教育法(行政法)上的教育主体(行政主体)资格;高等学校自主权在性质上是一种公共权利,其内容应由教育法加以规定。应当继续改进教育立法的模式,以更好地落实高等学校自主权。
Based on the legislation of higher education in our country, this part analyzes the establishment process of the status of the legal person in higher education institutions, the nature of the legal person in colleges and universities as well as the autonomy of colleges and universities. Based on this, it evaluates the empowerment model of higher education legislation and other specific problems ,make a suggestion. The author believes that institutions of higher learning both include their civil subject qualification in civil law as well as their qualification as the main body of education (administrative subject) in the Education Law (Administrative Law). The autonomy of colleges and universities is a kind of public right in nature, Its content should be provided by the Education Act. We should continue to improve the model of education legislation so as to better implement the autonomy of higher education institutions.
