2012年新《民事诉讼法》对我国司法鉴定人制度相关条款作出了修订,尤其是司法鉴定人的诉讼地位产生了细微而敏感的调整。司法鉴定人作出的“鉴定意见”不再是不可置疑的,为提高当事人对相关鉴定事项的程序主体地位,还赋予了当事人聘请专家辅助人制衡司法鉴定人的权利,从而对司法鉴定人的诉讼地位产生了细微但深远的影响。但司法鉴定人与专家辅助人并存的“双层”专家证据制度并不能根本解决司法鉴定人作为法官辅助人、当事人无实质性程序选择权产生的弊端。因此,需要重新定位司法鉴定人的诉讼地位,并同时改革与此相关的一系列程序性措施,从而重新激发司法鉴定制度的活力。
