目前,审判管理的重要性越来越受到重视。如何加强审判管理,确保公正、高效的司法目标的实现,是一个亟待破解的司法难题。审判管理包括审判工作的过程管理(即审判流程)和审判工作的结果管理(即绩效考评)。审判流程管理是指法院内部由专门机构根据案件性质及审理(含执行案件,下同)过程中的不同环节和阶段,结合各部门的职能分工,进行组织、跟踪、监督的审判运行程序和法院内部的管理机制。司法工作在价值取向上具有多向性,且判断价值目标是否实现具有相当大的主观性。同时,司法产品的非大众化特性决定其难以进行量化考核。
