我国立法活动频繁,纵观我国法律清理的历史不难发现我国法律清理的进程远远落后于法律法案的制定。从而出现法律的频繁修改致使司法解释的“刷屏”现象,以及法律之间相互冲突、不知如何适用,此外没有及时清理导致立法数量繁多而质量低下。因此,及时跟进下位法的清理及使用包裹立法是解决以上问题的可行途径。
The frequent legislative activities in China make a general survey of the history of the legal clean-up in our country. It is not difficult to find that the process of legal clean-up in our country lags far behind that of the legal act. Therefore, the frequent revision of the law led to judicial interpretation of the phenomenon of “brush”, as well as the conflict between laws, I do not know how to apply, in addition, lack of timely clean-up resulted in a large number of legislative and poor quality. Therefore, the prompt follow-up of the lower law of the cleaning and use of parcel legislation is a feasible way to solve the above problems.
