始于上世纪末的高等教育体制改革,促进了高等学校学生自主意识的提高。这种变革,导致了以校内学生为主体的校内纠纷逐渐显化,类型也在不断扩展之中。面对高校学生纠纷的日益显现,高校自身固守管理者姿态的“强硬”回应,抑或步履蹒跚之变革,均难以与校内纠纷解决的实际需求相适应,相反却促使高校学生校内纠纷走向两个极端:一是学生长期隐忍下所造成的人格变异;另一则是迈向法庭的公开抗争。显然,此种结果既不利于高校人才之培养,也不利于社会和谐稳定。故而,畅通高校学生维权之途,建构一种便捷、高效的纠纷解决机制势在必行。

In the face of the increasing appearance of university students ’disputes, the “toughness” response of colleges and universities themselves clinging to managers’ attitude, or the faltering reform, are difficult to adapt to the actual needs of the dispute resolution on the contrary, on the contrary, they promote the disputes among college students to two One extremes: one is the personality variation caused by students’ long-term tolerance; the other is the open fight toward the courts. Obviously, such a result is not conducive to the training of university personnel, is not conducive to social harmony and stability. Therefore, it is imperative to build a convenient and efficient dispute resolution system by unblocking the rights of college students.
