某国家级机械进出口公司和莱省级机械进出口公司(以下称“买方”)与西班牙某公司(以下称“卖方”)签订了一份《买卖合同》。买方以由西班牙莱信贷基金(以下称“信贷方”)提供出口信贷的形式向卖方购买了一套机床和热处理设备(以下称“设备”),设备的最终用户为某齿轮厂(以下称“用户”)。合同签订后,买方与信贷方签订了信贷协议,卖方按合同约定把设备运到了用户所在地。但是在卖方安装、调试设备的过程中,该设备的各种调试数据均达不到合同约定的技术参数标准,一拖就拖了数年。用户最后找到了本律师,希望通过法律途径解决卖方与用户之间欠拖不决的问题。
A state-owned machinery import and export company and Lai province-level machinery import and export company (hereinafter referred to as “buyer”) and the Spanish company (hereinafter referred to as “seller”) signed a “sales contract.” The buyer purchased a set of machine tools and heat treatment equipment (hereinafter referred to as “equipment”) from the seller in the form of export credit provided by Lesotho Credit Suisse (“Credit”), whose final user was a gear factory (Hereinafter referred to as “user”). After signing the contract, the buyer and the credit side signed a credit agreement, the seller agreed to the contract the device shipped to the user location. However, during the installation and commissioning of the equipment by the seller, all kinds of commissioning data of the equipment failed to meet the technical standards stipulated in the contract and dragged down for several years. The user finally found the lawyer, hoping to solve the undeclared problems between the seller and the user by legal means.
