随着经济市场化程度的加深,制订符合中国国情的反垄断法已是没有争议的问题,特别是在一些由市场机制调节,对外开放度较高的行业领域,既有的《反不正当竞争法》已不足以起到反垄断的作用,海运服务业便是这样一个产业部门。《反垄断法》(草案)中对海运服务业并没有做出明确规定,而海运服务又是WTO服务贸易中的一个重要行业,为了规范海运服务业,应将其纳入《反垄断法》调整范围。 With the deepening of the marketization of the economy, the formulation of the anti-monopoly law in line with China’s national conditions has become a matter of no dispute. In particular, in some industries regulated by the market mechanism and open to the outside world, the existing “anti-unjust competition Act ”is not enough to play the role of anti-monopoly, shipping service industry is such an industrial sector. The “Antitrust Law” (Draft) does not provide any explicit stipulations on maritime transport service, and maritime transport service is another important trade in WTO service trade. In order to standardize maritime transport service, it should be included in the “Anti-monopoly Law” adjustment range.
