不动产统一登记制度是我国物权法律制度建设的重要里程碑。农村土地、房屋不动产统一登记具有九种类型、三大事项,分为共同申请和单方申请两种不动产登记情形;不动产统一登记机构负有对申请登记材料的审理与查验、对不动产统一登记信息的共享与保护职责。农村土地、房屋不动产统一登记存在的主要问题,一是不动产统一登记的法律依据和配套制度不健全,二是不动产统一登记的政策界限和操作规程不明晰,三是不动产统一登记对农村住房和宅基地的规定不契合。为此就必须依法明晰不动产登记的法律依据和责任制度,规定不动产登记人员的任职资格和操作规程,确认村民小组在不动产登记中的主体地位。
The unified registration system of real estate is an important milestone in the construction of legal system of real right in our country. There are nine types and three major issues in the unified registration of rural land and real estate. They are divided into two types: joint application and unilateral application for registration of real estate. The unified registration agency for real estate shall have the hearing and examination of the application materials for registration and the unified registration of real property Sharing and protection responsibilities. The main problems existing in the unified registration of rural land and real estate are the legal basis and supporting system for the unified registration of real property, the second is the unclear policy boundary and operating procedures for the unified registration of real property, the third is the unified registration of real property for rural housing and houses The provisions of the base do not fit. To this end, we must clarify the legal basis and responsibility system for registration of real estate according to law, stipulate the qualifications and operating procedures of real estate registration staff, and confirm the subordinate position of villagers’ groups in real estate registration.
