电子商务纠纷中,如当事人与注册人的信息之间具有紧密关联,则可认定其原告主体资格。这种紧密关联需要法官综合案件各种要素予以动态考量。在审查被告主体资格时,应当从利益衡量的角度出发保护网络服务消费者的诉讼程序权利。如双方达成一致,协议确认电子数据可用于解决争议。在没有相反证据时,服务商保存的后台电子数据可以作为纠纷的评判依据。如果服务商按照双方事先确认的活动规则处理事务,应当认为其履行了网络交易平台服务商的合同义务与管理责任。
