随着农村经济的发展和城镇化步伐的加快,农村房屋交易日益频繁,出现了农村宅基地使用权流转的现象,出现了众多“小产权房”。“小产权房”虽然没有国家颁发的土地使用证和预售许可证,不受国家法律保护,但是由于其价格低廉,颇受部分城市购房者的青睐。这样,就必然涉及到一个新的问题——农村宅基地使用权流转问题。本文介绍了农村宅基地使用权的概念、立法沿革及其现状,并提出了细化立法的必要性。
With the development of rural economy and the accelerating pace of urbanization, rural housing transactions have become increasingly frequent, resulting in the phenomenon of the circulation of the right to use homesteads in rural areas and the emergence of many “small property houses.” Although there is no land use certificate and pre-sale permit issued by the state, it is not protected by national laws, but because of its low price, it is popular among some urban homebuyers. In this way, it is bound to involve a new problem - the circulation of rural land use rights. This article introduces the concept of rural housing land use rights, legislative evolution and status quo, and proposed the need for detailed legislation.
