老字号的曾经是辉煌的,但当下老字号企业却不断在没落。老字号字号本身的侵权亦构成没落的原因之一,为了在现有法律规定下更好的保护老字号,本文就侵权情况、侵权原因、被侵权老字号主张权利情况等进行考察,从老字号被侵权现状及原因分析出发,进行国内法考察,并针对未注册老字号为商标以及注册老字号为商标的不同情况进行分析并提出建议,力求让企业在现有法律框架下更好的寻求对老字号的法律保护。
