答:在《唐律》的《名例律》、《斗讼律》和《捕亡律》里,都有“同居有罪相为隐”的规定。但这一法律规范的渊源是很古的。《论语·子路》:“叶公语孔子曰:吾党有直躬者,其父攘羊而子证之。’孔子曰:‘吾党之直者异于是,父为子隐,子为父隐,直在其中矣。’”《韩非子·五蠹》也说:楚有直躬,“其父窃羊而谒之吏”,为令尹所杀,其罪名是:“直于君而曲于父。”韩非之意与孔子同,子不为父隐是有罪的;反过来应该是:“父为子隐,子为父隐。”《汉律》规定:“亲亲得相首匿。”(见《公羊传》“闵公元年”何注引。)董仲舒断疑狱,据《春秋》之义,肯定“父为子隐”是正当的、无罪的。可见《汉律》和孔子、韩非的思想不无关联。
