分期支付保险费的保险合同往往会因为投保人的主观或客观原因没有交付当期保险费而效力中止,但无论是从保护投保人、被保险人及受益人利益的角度,还是从保护保险人利益的角度,法律都会给效力中止的保险合同以重新恢复效力的机会,即保险合同的复效。由此可见,保险合同的复效制度是保险法中重要的、特有的制度。因此,我国原《保险法》和新《保险法》均对保险合同的复效制度作了规定,而且相对于原《保险法》,新《保险法》对相关内容做了部分的修改,以进一步对复效制度的规定进行完善。
