辩诉交易制度在美国司法领域发挥着极其重要的作用,许多国家都对其进行了研究、借鉴。笔者认为,我国有必要建立适合国情的辩诉交易制度,辩诉交易的建立需要一系列的配套措施,沉默权就是其中之一。沉默权和辩诉交易是共同作用的,二者可以相互取长补短,本文就辩诉交易下的沉默权规则进行分析,以期建立与辩诉交易共同作用的沉默权制度。
The system of plea bargaining plays an extremely important role in the judicial field of the United States, and many countries have conducted research on it for reference. The author believes that it is necessary for our country to establish a system of plea bargaining that suits our national conditions. The establishment of plea bargaining needs a series of complementary measures. The right to silence is one of them. The right to silence and the plea bargain together. The two can complement each other. This article analyzes the right to silence rules under the plea bargaining with a view to establishing a system of right to silence that works with plea bargaining.
